Terms of Service

These Terms of Service ("Terms") govern your use of FaceSign's identity verification platform and related services. By accessing or using our services, you agree to be bound by these Terms.

Acceptance of Terms

By accessing or using FaceSign's services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Services Description

FaceSign provides AI-powered identity verification services, including but not limited to:

  • Live video-based identity verification through AI avatar conversations.
  • Biometric matching and liveness detection.
  • Deepfake and synthetic media detection.
  • Behavioral analysis and coercion detection.
  • API access for integration into customer applications.

Use Restrictions

You agree not to use FaceSign's services to:

  • Violate any applicable laws or regulations.
  • Conduct surveillance or monitoring without proper authorization and consent.
  • Discriminate against individuals based on protected characteristics.
  • Reverse engineer, decompile, or disassemble any part of the service.
  • Attempt to circumvent security measures or access controls.
  • Use the service in a manner that could harm, disable, or impair the service.

Data Processing

Data processing is governed by our Privacy Policy and any applicable Data Processing Agreement (DPA) executed between FaceSign and the customer. Enterprise customers are responsible for obtaining appropriate consent from end users before initiating verification sessions.

Intellectual Property

All intellectual property rights in the FaceSign platform, including software, algorithms, models, and documentation, remain the exclusive property of FaceSign, Inc. Customers retain ownership of their data and are granted a limited, non-exclusive license to use the services during the term of their agreement.

Limitation of Liability

To the maximum extent permitted by applicable law, FaceSign shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services. Our total liability shall not exceed the fees paid by the customer in the twelve months preceding the claim.

Termination

Either party may terminate the service agreement in accordance with the terms of the applicable order or subscription agreement. Upon termination, FaceSign will delete customer data in accordance with our data retention policy, unless longer retention is required by law.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
